CUSTODY PROPOSED AGAINST THREE SUSPECTS FOR ILLICIT TRAFFICKING IN NARCOTIC DRUGS

Prosecutor of the BiH Prosecutor’s Office has put forward a motion with the Court of BiH seeking custody against three persons suspected of the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195(1) of the Criminal Code of Bosnia and Herzegovina, and pursuant to Article 139 of the Criminal Procedure Code of Bosnia and Herzegovina.

Prosecutor of the Department III of the Prosecutor’s Office of BiH has put forward a motion with the Court of BiH seeking custody against the following persons:

1. Milan Milatić, born on 01 September 1991 in Peć, Republic of Serbia, residing in         Podgorica, citizen of the Republic of Serbia,

2. Miloš Pavićević, born on 31 August 1991 in Podgorica, Republic of Montenegro,      where he also resides, citizen of Montenegro and

3. Ivona Vučić, born on 13 May 1991 in Podgorica where she also resides, citizen       of Montenegro.

These suspects were deprived of liberty on 09 October 2012, around 10 PM, by the authorized officers of the Border Police of BiH, whereupon they were handed over to the Prosecutor’s Office of BiH within the statutory time.  

The Prosecutor’s Office of BiH is charging Milan Milatić, Miloš Pavićević and Ivona Vučić with attempting to smuggle across the BiH state border more than 11 kilograms of marijuana for the purpose of its further international sale, from which they were prevented by the authorized officials of the BiH Border Police.   

Having questioned the suspects, the Prosecutor in charge of this case put forward a motion with the Court of BiH seeking custody for reasons as described in Article 132 (a) of the BiH CPC.

The measure of custody was proposed due to the possibility of flight of these suspects either to the Republic of Montenegro or to the Republic of Serbia, and these countries do not extradite their own citizens for crimes these suspects are charged with; therefore, in case of flight, they would become unavailable to the law enforcement agencies. 

The proposal for custody has been forwarded to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
