CUSTODY PROPOSED AGAINST FOUR SUSPECTS
28.09.2012. 15:15As part of the investigation in this case, the Police Department of the Federation of BiH submitted a report on the committed criminal offense to the Prosecutor’s Office of BiH due to the existence of a grounded suspicion that these suspects committed the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195(1) of the Criminal Code of Bosnia and Herzegovina.
Having questioned the suspects, the Prosecutor in charge of this case put forward a motion with the Court of BiH seeking the measure of custody for the following persons:
- T.H., born in 1965,
- K.S., born in 1988
- J.D., born in 1987 and
- K.S., born in 1993
The measure of custody was proposed for reasons as prescribed by Article 132(1)(a) and (b) of the BiH CPC, or due to the risk that, if at large, the suspects might hinder the criminal proceedings by influencing witnesses or accomplices, and in case of K.S. and K.S. due to the risk of flight, especially in view of the fact that these two are foreign citizens who, if at large, might leave the territory of Bosnia and Herzegovina and thus become unavailable to the law enforcement agencies.
The proposal for custody has been forwarded to the Court of BiH, and the Prosecutor’s Office of BiH continues its investigation in this case aimed at filing an Indictment.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
