INDICTMENT ISSUED AGAINST THREE PERSONS FOR CRIMES AGAINST HUMANITY COMMITTED IN VIŠEGRAD
14.09.2012. 15:05Prosecutor of the Regional Team III of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against the following persons:
- Predrag MILISAVLJEVIĆ AKA "Dragan", born on May 27, 1958 in Višegrad, residing in the Canary Islands in Spain, with temporary stay in Višegrad, a citizen of Bosnia and Herzegovina and the Republic of Serbia,
- Miloš PANTELIĆ AKA "Panta", born on October 3, 1965 in the municipality of Višegrad where he resides, a citizen of Bosnia and Herzegovina and the Republic of Serbia and
- Ljubomir TASIĆ AKA "Ljupko", born on July 12, 1956 in Višegrad where he resides, a citizen of Bosnia and Herzegovina.
All three suspects are in custody.
Predrag MILISAVLJEVIĆ and Miloš PANTELIĆ as members of the reserve police within the Public Security Station in Višegrad and Ljubomir TASIĆ as a member of the Republika Srpska Army, are charged with having knowingly taken part in a widespread and systematic attack of the RS Army, Republika Srpska police and paramilitary formations directed against the Bosniak civilian population in the municipality of Višegrad during the period from April to June 1992 during which they have persecuted Muslim population in the municipality of Višegrad on ethnic and religious grounds by way of undertaking: killings, forcible transfer of population, imprisonment, torture, coercing another by force to engage in any form of sexual violence, enforced disappearance of persons and other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to physical or mental health.
As alleged in the indictment, the three suspects have in the morning of June 14, 1992, together with other armed members of the Serb army and police, participated in the forced transfer of Bosniak civilians from Višegrad and several surrounding villages, who were forced to leave their homes and were transferred from a square in Višegrad to the territory controlled by the Army of Bosnia and Herzegovina.
The indictment also alleges that the suspects Predrag MILISAVLJEVIĆ and Miloš PANTELIĆ have, on June 15, 1992, together with other members of the Serb police and army, escorted the bus transporting captured Bosniak civilians from Rogatica. The captured Bosniak civilians were ordered to hand over personal documents, money, jewelry and other valuables after which their hands were tied with wire and they were loaded back into the bus which stopped at about 100-150 meters away from "Paklenik" pit located near Kalimanići village in the municipality of Sokolac. The men were then ordered to sing Serb songs, to get out of the bus, to line up in column of two by two and to walk towards the "Paklenik" pit where the majority of police officers and soldiers began shooting at them. The shooting was survived by only one civilian and 48 Bosniak men, including eleven of Kustura family, nine of Karaman family and six from Omerović family were killed.
The suspects Predrag MILISAVLJEVIĆ, Miloš PANTELIĆ and Ljubomir TASIĆ are charged with having committed Crimes against Humanity under Article 172, Paragraph 1, Subparagraph h) of the CC BiH, in conjunction with Article 29 (Co-perpetration) of the CC BiH, all in conjunction with Article 180, Paragraph 1 of the CC BiH.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
