ENVER OKANOVIĆ, MEHMED LIBIĆ AND ASMIR MAŠIĆ CONCLUDED PLEA AGREEMENTS
05.09.2012. 15:15The following accused persons entered into plea agreements with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the BiH Prosecutor's Office:
- Enver Okanović, born on April 24, 1964 in Bihać, where he resides, citizen of BiH,
- Mehmed Libić, born on March 3, 1968 in Bihać, where he resides, citizen of BiH, and
- Asmir Mašić, born on May 17, 1968 in Bihać, where he resides, with prior convictions, citizen of BiH.
The accused admitted committing the criminal offenses listed in the indictment as follows: the accused Okanović admitted committing the criminal offense Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the Criminal Code of BiH, in conjunction with the criminal offense of Unauthorized Production and Sale of Narcotic Drugs under Article 238, Paragraph 1 of the Criminal Code of Federation BiH; the accused persons Libić and Mašić admitted committing the criminal offense of Abuse of Office or Official Authority under Article 383, Paragraph 1 of the CC FBiH, in conjunction with Article 55 of the same code (continued criminal offense).
By virtue of signing the agreements the accused fully admitted committing the criminal offenses they were charged with by the indictment of the Prosecutor’s Office of BiH dated January 12, 2012 which was confirmed by a pre-trial judge of the Court of BiH on January 25, 2012.
The prosecutor and the defense agree that pursuant to the agreement the accused Enver Okanović be rendered a suspended imprisonment sentence of two (2) years by the Court of BiH, that shall not be executed providing that the accused does not commit another criminal offense with the period of four (4) years; the accused Libić be rendered a suspended imprisonment sentence of one (1) year and six (6) months that shall not be executed providing that the accused does not commit another criminal offense with the period of three (3) years; the accused Asmir Mašić be rendered a suspended imprisonment sentence of five (5) months and fifteen (15) days, as well as that safety measure – forfeiture of items used or intended for commission of the criminal offense and proceeds of crime.
The proposed sentence is in line with the roles of the accused in commission of the crimes listed in the indictment in the case Vs. Ramo Brkić et al.
By virtue of the plea agreements the accused have pledged to testify on all facts they are familiar with in this case as well as all perpetrators, co-perpetrators and accomplices in commission of the crime including all crimes they were involved in that the accused are aware of. The accused agree to testify before the Court of BiH when summoned by the Court of BiH.
With these agreements the accused confirm that they are aware of the content of the indictment issued by the BiH Prosecutor's Office. They also confirm that the plea statements were given voluntarily, knowingly and with full understanding and undertake to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.
Pursuant to this agreement the accused waived their rights to a trial and appeal to the criminal sanction that shall be rendered to them by the Court of BiH.
The agreements were submitted to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
