INDICTMENT FILED AGAINST ZLATKO MARIJANOVIĆ (1977)

Prosecutor’s Office of BiH has filed an Indictment against Zlatko Marijanović, charged with the criminal offense of Illicit Trade in Excise Products under Article 210a, Paragraph 1, in conjunction with Article 26 of the Criminal Code of Bosnia and Herzegovina.

Prosecutor of the Section III of the BiH Prosecutor's Office has filed an Indictment against Zlatko Marijanović, born on 02 February 1977 in Grude Municipality where he also resides, a citizen of BiH.

On 03 July 2012, at 02:30 AM, using a passenger’s motor vehicle of make Ford Focus at the M-14 highway in Bihać Municipality, the accused Zlatko Marijanović is alleged to have attempted to put into circulation goods described in Article 6 of the Law on Excise Duties of BiH (‘Official Gazette of BiH’, No. 49/09), as other tobacco products- pipe tobacco and smoking tobacco, in a manner that he transported in the aforementioned vehicle the total amount of 200 kilograms of finally processed tobacco, placed in 18 bags weighing 10 to 12 kilograms and in 500 boxes-packages, which he intended for retail resale in order to gain profit.

As alleged in the Indictment, the accused did not have any documents for the aforementioned goods, nor were the goods marked with excise tax stamps; therefore, his further intent was prevented by a patrol of the Traffic Control Police Unit of the Una-Sana Canton Ministry of the Interior.  

The accused Zlatko Marijanović is charged with attempting to put into circulation  products not marked with tax stamps in the manner prescribed by the BiH tax legislation, whereby he committed the criminal offense of Illicit Trade in Excise Products under Article 210a, Paragraph 1, in conjunction with Article 26 of the Criminal Code of Bosnia and Herzegovina.

The Indictment has been forwarded to the Court of BiH for confirmation.
