INDICTMENT FILED AGAINST DRAGAN RADIĆ (1982)
05.06.2012. 15:32Prosecutor of the Section III of the BiH Prosecutor's Office has filed an Indictment against Dragan Radić, born on 26 January 1982 in Loznica, Republic of Serbia, resident of Zvornik, citizen of BiH.
Allegedly, on 10 May 2012, around 9 PM, using his own passenger’s motor vehicle, the accused Dragan Radić arranged with a person from the Republic of Serbia that this person transport to him across the Drina River into BiH cigarettes of Walter Wolf brand; he then took over 4000 boxes of Walter Wolf cigarettes in the territory of BiH with excise stamps of the Republic of Serbia in the value of 11,473.21 BAM, in order to resell those cigarettes and thus gain profit, without having any documents on the origin of goods, or documents on import of goods to BiH, or approval to engage in trade, which is in violation of the current legal provisions on excise duties; he was prevented from doing so by officers of Zvornik Border Police Unit.
The accused Dragan Radić is charged with unlawful attempt to put into circulation or sell products not marked with control and tax stamps in the manner prescribed by the BiH tax legislation, whereby he committed the criminal offense of Illicit Trade in Excise Products under Article 210(a), Paragraph 1, in conjunction with Article 26 of the Criminal Code of Bosnia and Herzegovina.
The Indictment has been forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
