INDICTMENT ISSUED AGAINST MILAN LEKO (1969)

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor's Office of BiH issued an indictment against Milan Leko, born on September 12, 1969 in Sarajevo, residing in the municipality of Grude, citizen of BiH and the Republic of Croatia.

The accused Milan LEKO is charged to have, on several occasions, during the period from July 22 to September 19, 2010 and after obtaining a greater amount of unmarked excise goods from a person known to him with the intention of putting it into circulation, taken the exercise goods out of his home in Grude to put it in circulation i.e. to sell excise goods - cigarettes of various brands that were not marked by control and tax stamps in the manner prescribed by BiH Tax legislation, contrary to Article 25 of the Law on Excise Duties in Bosnia and Herzegovina.

According to the indictment, the accused LEKO is charged to have, kept a pistol without a corresponding magazine for the ammunition, in his house without permission and supporting documentation on the origin of the pistol, as well as two pistol magazines and 28 bullets of unknown caliber, whose possession is prohibited by Article 11 of the Law on Weapons (Official Gazette of WHC no. 4/2001).

The specified excise goods, firearms and ammunition were found on December 22, 2010 and temporarily seized by police officers of the Federation Police Directorate.

The accused Milan LEKO is alleged to have put on the market products that were not marked with control and tax stamps in the manner prescribed by the BiH tax legislation, and to have kept firearms without permissions whose acquisition is not allowed for citizens, and is thus charged to have committed the criminal offense of Illicit Trade in Excise Products under Article 210a, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina and the criminal offense of Illegal Possession of Weapons or Explosive Substances under Article 371, Paragraph 1 of the Criminal Code of the Federation BiH.

The indictment was forwarded to the Court of BiH for confirmation.
