INDICTMENT AGAINST HARIS PEZO (1970) FILED
18.04.2012. 08:48The Indictment charges Haris Pezo, as an owner of a photocopying shop in Zenica and another photocopying shop in Travnik, with storing electronic forms of author’s works in his computer and illegally multiplying and distributing thus multiplied author’s works in forms of textbooks and books of various publishers and authors, on his business premises, without the authorization of the author or other holder of copyright, or the person entitled to give authorization, knowing that those were illegally multiplied copies, all contrary to Article 20, Article 21 and Article 22 of the Copyright and Related Rights Law („Official Gazette of BiH“, No. 63/10).
As alleged in the Indictment, the search of his business premises, conducted on 30 November 2011, resulted in finding 31 piece of illegally multiplied books and textbooks, 9 of which were found in Zenica, and 22 of which were found in Travnik. All these books and textbooks were temporarily forfeited by authorized officials of the State Investigation and Protection Agency -SIPA, Sarajevo Regional Office.
The accused Haris Pezo is charged with distributing author’s works multiplied without the authorization of the author or other holder of copyright, or the person entitled to give authorization, where such authorisation is required under the provisions of the laws of Bosnia and Herzegovina, whereby he has committed the criminal offense of Impermissible Use of Copyrights, as referred to in Article 243(1) of the CC BiH.
The Indictment has been submitted for confirmation to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
