MOTION FOR CUSTODY AND PROHIBITIVE MEASURES FILED FOR SIX PERSONS
26.03.2012. 15:26- Đ.Ž. (1948), born and residing in Sarajevo, BiH citizen,
- M.H. (1965), born and residing in Sarajevo, citizen of BiH and the Kingdom of the Netherlands,
- E.K. (1974), born in Mostar, residing in Jablanica, citizen of BiH, and
- I.K. (1962), born and residing in the municipality of Zenica, citizen of BiH and the Kingdom of the Netherlands.
Prohibitive measures were sought for the following suspects:
- Dž.F. (1964), born and residing in Sarajevo, BiH citizen and
- Đ.K. (1976), born in Mostar, residing in Jablanica, citizen of BiH.
The suspects Đ.Ž., M.H., E.K., Dž.F. and Đ.K. were deprived of liberty late in the evening of March 23, 2012 in the areas of the municipalities of Jablanica and Hadžići, while the suspect I.K. was deprived of liberty in the early morning of March 24, 2012 in the municipality of Zenica.
All suspects were apprehended by authorized officers of the State Investigation and Protection Agency - SIPA, for suspicion of being involved in the sale of at least 7 kg of narcotic Amphetamine. During the arrest 7 kg of "speed" and 4 kg of a substance used as drug admixture were seized.
Following the questioning of the suspects the Assigned Prosecutor filed a motion with the Court of BiH to remand four suspects into custody for the duration of 30 days.
Custody was requested on grounds stipulated in Article 132, Paragraph 1, Subparagraph b) of the CPC BiH i.e. due to risk that, if released, the suspects could exert influence on the witnesses or accomplices and interfere with the investigation. Custody for the suspect M.H. was requested on grounds stipulated in Article 132, Paragraph 1, Subparagraph a) i.e. due to risk of flight, while the custody of the suspect I.K. was requested on ground stipulated in Article 132, Paragraph 1, Subparagraph c) i.e. due to risk that that suspects may repeat the criminal offense.
Prohibitive measures were sought for two suspects on the basis of Article 35, Paragraph 2 in conjunction with Article 126, 126 a) and 126 b) of the CPC BiH. The prohibitive measures sought are: house arrest, travel ban, ban on meeting with other suspects, as well as order of reporting to a specified state agency.
All suspects are under investigation by the Prosecutor's Office of BiH and are suspected of a criminal offense of Organized Crime under Article 250, Paragraphs 2 and 3 in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the CC BiH and the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 238 Paragraph 1 of the CC FBiH.
Custody motion is filed with the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
