CUSTODY MOTION FILED FOR FIVE PERSONS
23.03.2012. 15:33- K.G. (1969), a citizen of the Republic of Montenegro,
- A.A. (1982), a citizen of the Republic of Montenegro,
- K.D. (1976), a citizen of BiH,
- J.M. (1964), a citizen of the Republic of Montenegro and
- K.D. (1979), BiH citizen.
The suspects K.G., A.A. and K.D. were deprived of liberty on March 20, 2012 at around 21:30 hrs. in Trnovo and the wider area of Sarajevo, the suspects J.M. and K.D. were deprived of liberty on March 21, 2012 at around 13:30 hrs. in Foča.
All suspects were deprived of liberty by authorized officers of the State Investigation and Protection Agency - SIPA, while attempting to handover 10 kg and 665.5 grams of narcotic - Marijuana ("Skunk") to persons from Banja Luka, known to them, for its further distribution.
Following the questioning of the suspects the Assigned Prosecutor filed a motion with the Court of BiH requesting remand in custody for these suspects for the duration of 30 days.
Remand in custody was requested on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a) b) and c) of the CPC BiH, i.e. due to risk that the suspects could flee, as well as due to the fact that there is a risk that, if released, the suspects might repeat the criminal offense, exert influence on the witnesses or accomplices and interfere with the investigation.
These suspects are under investigation by the Prosecutor's Office of BiH and are suspected of committing the criminal offense of Organized Crime under Article 250 of the CC BiH and the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 of the Criminal Code of BiH.
Custody motion was filed with the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
