AN ORDER TO CLOSE THE INVESTIGATION OF GANIĆ ET AL WAS ISSUED

The Prosecutor's Office of BiH issued an order to close the investigation of the following persons: Ejup Ganić, Hasan Efendić, Zaim Backović, Jovan Divjak, Jusuf Pušina, Emin Švrakić, Dragan Vikić, Fikret Muslimović, Dževad Topić, Jovica Berović, Rešad Jusupović, Jusuf Kecman, Damir Dolan and Ibrahim Hodžić. The investigation was suspended because it was determined that the acts of the aforementioned suspects did not constitute the elements of a crime.

Following an extensive investigation, the order to close the investigation of the aforementioned suspects was made on the basis of statements of 352 witnesses and 412 pieces of material evidence, including documents, video files, intercepted communications and other evidence.

The investigation conducted found that the attack in Dobrovoljačka street resulted with the killing of 7 and injuring of 14 people, after they were rendered unable to fight. The investigation related to this matter and the consequences thereof shall continue, due to grounded suspicion that a criminal offense of war crimes was committed because the victims were fired at after they were rendered unable to fight or while they were in the ambulance vehicle.

During the investigation it was found that a part of the captured soldiers of the JNA (Yugoslav National Army) was taken to "FIS" premises, Central Prison, and TO (Territorial Defense) HQ where they were mistreated and abused. The investigation relating to this matter shall continue in the aim of determining the liability of known perpetrators, identifying other perpetrators, as well as determining the existence of any command responsibility.

Pursuant to the CPC BiH the Decision of the Assigned Prosecutor to close the investigation may be appealed by filing a complaint with the Office of the Chief Prosecutor.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
