INDICTMENT ISSUED AGAINST 4 PERSONS FOR AIDING GENOCIDE

Former members of the RS Army structures in the Vlasenica area are charged with forcible separation and killing of at least 21 Bosniak men, as well as forcible stopping and plundering of convoys that transported civilians after the fall of Srebrenica and the rape of women and girls forcibly separated from the convoy.
  • INDICTMENT ISSUED AGAINST 4 PERSONS FOR AIDING GENOCIDE

The Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of BiH issued an indictment against the following persons:

  1. Mile Kosorić, born in 1953 in Han Pijesak, prohibiting measures ordered,
  2. Borislav Stojišić AKA Boro  born in 1956 in Vlasenica,
  3. Momčilo Tešić AKA Crnac, born in 1974 in Vlasenica, prohibiting measures ordered,
  4. Rajko Drakulić, born in 1964 in Vlasenica.

The accused are charged with having, during a widespread and systematic attack by the RS Army and the RS MoI in the protected zone of Srebrenica in July 1995, acted contrary to the provisions of International Humanitarian Law and the Geneva Convention relative to the Protection of Civilian Persons in Time of War.

The accused are charged with having provided assistance to the perpetrators of the joint criminal enterprise in July 1995, while acting in their respective capacities: the accused Kosorić as the Commander of the Vlasenica Brigade of the RS Army and the other accused persons as commanders and members of the Military Police of the RS Army’s Vlasenica Brigade, knowing that the buses and convoys which transported civilians i.e. women and children after the fall of Srebrenica to Kladanj, will pass through  Luke a place where they set up a checkpoint and  stopped the convoy then conducted searches and seized money, gold and other valuable. They afterwards forcibly separated ethnic Bosniak men and girls.

The indictment alleges that the separated women were raped and sexually abused, and men - more than 20 of them, were taken away and forcibly imprisoned in a nearby school where their hands were tied and they were robbed and held in inhumane conditions. From that place the separated men were taken on 13/14 July 1995 to Mršići and shot. At least 21 men were killed and only one survived the shooting.

The accused are charged with having committed the criminal offense of Genocide under Article 171 of the Criminal Code of BiH in conjunction with Article 180 (1) and Article 31 of the CC BiH.

The indictment was forwarded to the Court of BiH for confirmation.
