INDICTMENT ISSUED FOR WAR CRIME COMMITTED IN FOČA

Dragan Janjić (1967) is charged with the commission of the war crimes of rape and sexual abuse of a victim of Bosniak ethnicity, as well as with aiding and abetting the unlawful imprisonment of civilian persons by committing unlawful deprivations of liberty, which was perpetrated in Foča, in 1992.
  • INDICTMENT ISSUED FOR WAR CRIME COMMITTED IN FOČA

Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following person:

-      Dragan Janjić, born in 1967 in Pljevlja, Montenegro, a citizen of Bosnia and Herzegovina and the Republic of Serbia.  

This accused person is charged with coming to a building in the vicinity of the Police Station during the widespread and systematic attack of the army, paramilitary and police forces of Republika Srpska directed against civilian Bosniak population of the Foča Municipality, in the period from the beginning of April until the end of September of 1992, while he was in his capacity of a member of the Police Station in Miljevina, and taking out a female Bosniak victim together with her family and bringing them all to the premises of the Police Station; there, he kept the victim in one room, under threat, and raped and sexually abused her. 

This accused person is charged with perpetrating, together with other members of the police, unlawful deprivations of liberty and imprisonments of Bosniak civilians in the police station in Miljevina, during the above-mentioned time period, although he was aware that there were no legal grounds for such actions and that the victims would thereafter be imprisoned in the Penal and Correctional Facility in Foča, which is in contravention of the basic principles of the international law. Some of the persons imprisoned there were killed, whereas some of them have yet been unaccounted for.

This accused person is charged with the commission of the criminal offence of Crimes against UmanityHumanity, as referred to in Article 172, Paragraph 1, items g) and e) in conjunction with Article 31 and Article 180 Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
