INDICTMENT ISSUED AGAINST THREE PERSONS FOR WAR CRIMES COMMITTED IN ROGATICA

A Prosecutor of the Special Department for War Crimes within the Prosecutor’s Office of BiH issued an indictment against the following persons:
  • INDICTMENT ISSUED AGAINST THREE PERSONS FOR WAR CRIMES COMMITTED IN ROGATICA

-   Dragan Lubarda, born in 1956 in Rogatica, a citizen of Bosnia and Herzegovina,

-   Zdravko Lubarda, born in 1954 in Rogatica, a citizen of Bosnia and Herzegovina and

-   Ozren Planojević, born in 1971 in Rogatica, a citizen of Bosnia and Herzegovina and the Republic of Serbia.

The accused are charged with having, while acting in their capacities: Dragan Lubarda and Ozren Planojević as members of the reserve units of Public Security Station Rogatica and Zdravko Lubarda as a member of the Army of Republika Srpska, undertaken actions thus actively participating in a widespread and systematic attack of the police, army and paramilitary units directed against the Bosniak civilians in Rogatica in the period from the end of May 1992 to the end of 1993.

The accused are charged with having been involved, personally and directly and together with other persons, in the unlawful imprisonment of Bosniak civilians, separation of men from women and children, the taking away, killings and forced disappearances of a number of Bosniaks.  The partial remains of some of the victims were found after the war and the remains of others are still to be found.

The accused are alleged to have participated in the persecution of Bosniak civilians in Rogatica on ethnic and religious grounds in connection with the killings, other severe deprivation of physical liberty in violation of fundamental rules of international law, enforced disappearance of persons and other inhumane acts of a similar character aimed at intentionally causing great suffering, or serious injury to body or to mental or physical health.

The accused are charged with having committed the criminal offense of Crimes against Humanity under Article 172 of the Criminal Code of Bosnia and Herzegovina.

The indictment was forwarded to the Court of BiH for confirmation.
