Department III

Department III of the Prosecutor's Office of BiH, in its organizational structure and essential functions retained the traditional form of work, which understands that there are no teams established in this Department, However, the Collegium of Prosecutor's is scheduled when necessary allowing the Prosecutors to cooperate with each other by way of exchanging work related opinions and experiences thus working together in overcoming the problems faced when working on assigned cases.

The newly adopted amendments to internal criteria for assignment of cases within the respective departments of the Prosecutor's Office of BiH from June 30, 2009 has, statistically speaking, caused a significant increase of cases for the Department due to transfer of cases from the Special Department for Organized Crime, Economic Crime and Corruption to Department III of the Prosecutor's Office of BiH, given that the property census has been increased for criminal offenses against the economy and market unity and criminal offenses related to customs and copyright infringement, which were previously assigned to the Special Department II in accordance with the earlier established internal criteria for the distribution of cases as of June 20, 2007.

In addition to that, the increase in the number of trafficked persons, and persons considered as victims of human trafficking in all matters relating to the criminal offense of Smuggling of Persons under Article 189 of the CC BiH and the criminal offense of Trafficking in Persons under Article 186 of the CC BiH, also contributed to the influx of additional cases of this kind in Department III, which was ultimately reflected in the total number of cases assigned to this Department. The aforementioned previous internal criteria of July 20, 2007 and the amendments thereto have assigned the following cases under the jurisdiction of Department III within the Prosecutor's Office of BiH:

1.Cases related to all the criminal offences falling within the competence of the Prosecutor's Office, except for:

-   Criminal offences falling within the scope of work of the Special Department for War Crimes within the meaning of Article II of the Criteria dated July 20, 2007,

-   Criminal offences falling within the scope of work of the Special Department for Organized Crime, Economic Crime and Corruption within the meaning of the newly adopted amendments to internal criteria dated June 30, 2009

2. Cases related to the criminal offences of 'corruption' committed by official persons and responsible persons who are not highly ranked officials or responsible persons holding highest offices in their companies or other legal entities within the meaning of Article III, Paragraph 3 of the Criteria

3. Cases related to extradition, requests for legal assistance and issues concerning mutual legal assistance and co-operation, and

4. Cases related to issues involving conflict of jurisdiction and cooperation with other prosecutor’s offices, courts, institutions and organizations.

-  Additional Protocol to the European Convention on Extradition, Strasbourg October 15, 1975;

-  Second Additional Protocol to the European Convention on Extradition, Strasbourg March 17, 1978;

-  European Convention on the Transfer of Proceedings in Criminal Matters, Strasbourg, March 15, 1972;

-  European Convention on the Transfer of Sentenced Persons, Strasbourg, March 21, 1983;

-  European Convention on Information on Foreign Law, London, June 7, 1968;

- Additional Protocol to the European Convention on Mutual Assistance in Criminal Matters, Strasbourg, March 17, 1978;

- Convention of the Southeast European Law Enforcement Center, Bucharest May 26, 1999.

In addition to these conventions, Bosnia and Herzegovina has, by notification of succession, taken over a large number of international bilateral agreements on legal assistance.

Of particular importance for Bosnia and Herzegovina is the ratification of the Copyright Treaty of the World Intellectual Property Organization adopted at the Diplomatic Conference on January 20, 1996 as there is an evident increase of copyright infringement cases in Bosnia and Herzegovina every year, which is why a number of multi-day seminars were held during the past years, aiming to improve training of Prosecutors in this field.
