INDICTMENT ISSUED AGAINST THREE PERSONS FOR ASSOCIATING TO PERPETRATE CRIMINAL OFFENCES AND ROBBERY IN AUSTRIA, WHICH RESULTED IN DEATH OF OWNER OF ROBBED HOUSE

In association with partner institutions from Austria, the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against three citizens of Bosnia and Herzegovina who participated in the perpetration of the criminal offence which had the death of an Austrian citizen as a consequence. Having committed the said criminal offence, they fled to Bosnia and Herzegovina.  
  • INDICTMENT ISSUED AGAINST THREE PERSONS FOR ASSOCIATING TO PERPETRATE CRIMINAL OFFENCES AND ROBBERY IN AUSTRIA, WHICH RESULTED IN DEATH OF OWNER OF ROBBED HOUSE

 Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption has issued an Indictment against the following persons:

 

 

1. Ferald Gazibarić Gučanin aka Ferdo, born in 1971 in Travnik

 

2. Oliver Sivonjić aka Oli, born in 1970 in Travnik

 

3. Dalibor Ivančević, born in 1975 in Banja Luka

 

 

All three accused persons have had prior convictions.

 

These accused persons are charged to have come to the territory of the Republic of Austria, in the spring of 2011, and, together with two other persons, joined an organized criminal group which was established for the purpose of committing serious crimes of robbery and burglary of the houses and apartments belonging to Austrian citizens, all for the purpose of acquiring substantial illegal material gain.

 

Namely, on 20 April 2011, after they had used force to enter and rob the house of an Austrian citizen Elisabeth F. in Gosau, Austria, the accused persons tied up the aforementioned elderly lady when the noise woke her up, and they left her thus tied up and gagged with cloth so that she could not cry for help, all of which resulted in the death of this Austrian citizen.

 

These accused persons are charged with the commission of the criminal offence of Associating for the Purpose of Perpetrating Criminal Offences, as referred to in Article 249 of the Criminal Code of Bosnia and Herzegovina, and the criminal offence of Robbery, as referred to in Article 288 of the Criminal Code of the Federation of Bosnia and Herzegovina.

 

Two of the perpetrators of this criminal offence had already been arrested and convicted in the Republic of Austria, whereas the three other perpetrators had fled to Bosnia and Herzegovina and were unavailable to the Austrian judiciary. Following an intensive cooperation with the institutions of Bosnia and Herzegovina, this case was transferred to the BiH judiciary.
