CUSTODY MOTION FOR BIH BORDER POLICE MEMBER SUSPECTED OF CRIMINAL OFFENCE OF CORRUPTION
The Prosecutor’s Office of BiH filed a custody motion for the suspect Slavko Čuljak*, aka "Mida", born in 1980 in Sarajevo, employed as a police officer of the BiH Border Police. The custody motion was filed for the reasons described in Article 132, paragraph 1, item b) of the BiH CPC, namely due to the risk that the suspect, by remaining at large, could obstruct the investigation, conceal evidence and influence witnesses or accomplices. The suspect is charged with taking money and three travel documents (two of the Republic of Turkey and one of North Macedonia) from a foreign citizen outside of working hours in the area of East Sarajevo, in order to falsely enter the aforementioned persons, for reasons they needed, into the system of entry and exit of foreign citizens, which is maintained by the BiH Border Police. He is charged with committing the criminal offense of Abuse of Office or Authority under Article 220 and Accepting Gifts and Other Forms of Benefit under Article 217 of the Criminal Code of BiH.
PERSON ACCUSED OF CORRUPTIVE CRIMINAL OFFENSE CONCLUDED PLEA AGREEMENT
The accused Nedeljko Budić *, born in 1970, employed as a customs officer of the ITA at the BC Gradina, pleaded guilty by mutual agreement to the criminal offense of Accepting Gifts or Other Form of Benefits under Article 217 of the CC BiH. A prison sentence of 6 months, as well as a fine in the amount of BAM 1000, was proposed for the accused. The accused was removed from the service in the ITA of BiH, and was banned from performing the job, activities or duties of a customs officer in the ITA BiH for a period of 2 years. Unlawful property gain in the amount of EUR 20 was confiscated from the accused. After consideration, the Court of Bosnia and Herzegovina accepted the plea agreement and sentenced the accused.
INDICTMENT ISSUED FOR THE CRIMINAL OFFENCE OF SMUGGLING OF PERSONS
The Prosecutor’s Office of BiH issued an indictment against Mersudin Kurbegović*, born in 1997 in Pljevlja, a citizen of the Republic of Montenegro, who is in custody. He is charged with having attempted to smuggle 30 migrants, citizens of the People’s Republic of China, who did not meet the conditions for legal crossing of the state border from BiH to the Republic of Croatia, on 24 September last year, with the intention of obtaining unlawful property gain, while driving a cargo motor vehicle with license plates of the Republic of Montenegro, but was stopped at the Gradina/Jasenovac border crossing point by Officers of the Republic of Croatia Ministry of interior. The accused is charged with committing the criminal offence of Smuggling of Persons under Article 189, paragraph 1, in conjunction with Article 26 of the Criminal Code of BiH.
INDICTMENT ISSUED FOR CRIMINAL OFFENSE OF SMUGGLING OF PERSONS
The Prosecutor’s Office of Bosnia and Herzegovina issued an indictment against Mustafa Jilmaz*, born in 1984 in Alaçam, Republic of Turkey, a citizen of Bosnia and Herzegovina. It is alleged that on 22/23 September 2024 he accepted to transport, for an agreed amount of money, a Turkish citizen who was banned from entering Bosnia and Herzegovina, from the area of Nikšić to the border between Montenegro and Bosnia and Herzegovina. He then enabled the person in question to illegally cross the state border and enter the territory of Bosnia and Herzegovina on foot, bypassing the official border crossing. During the further transportation of this person who did not meet the conditions for legal entry and stay in the territory of Bosnia and Herzegovina, he was stopped and prevented by the police officers of the BiH Border Police in Prijeđel, Foča municipality. The accused is charged with committing the criminal offense of Smuggling of Persons under Article 189, paragraph 1, of the Criminal Code of BiH.
