INDICTMENT ISSUED FOR WAR CRIMES AGAINST CIVILIANS

The Prosecutor’s Office of Bosnia and Herzegovina issued an indictment against Enes Gurda*, born in 1961 in the municipality of Olovo, a citizen of Bosnia and Herzegovina, and Nihad Čamdžić - Brčaninović * aka "Mrakan", born in 1966 in Tuzla, citizen of Bosnia and Herzegovina. 

INDICTMENT ISSUED FOR WAR CRIMES AGAINST CIVILIANS

The accused are charged with having, during the war and the armed conflict between the RS Army and the Army of the Republic of Bosnia and Herzegovina, while acting in their capacity i.e., the accused Enes Gurda* as the security officer of TD Živinice and Nihad Čamdžić-Brčaninović * as a member of the Military Police of TD Živinice, acted contrary to the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War. The indictment alleges that, in the period from May to September 1992, they inhumanely treated and tortured the illegally imprisoned Serb civilians in detention facilities and premises in Živinice and the surrounding area, thereby causing them severe physical and mental pain and suffering, as well as injuries to their physical integrity and health. One civilian died as a result of the beating and abuse.


The accused are charged with having committed the criminal offense - War Crime against the Civilian Population under Article 142, paragraph 1, in conjunction with Articles 22 and 48 of the Criminal Code of the SFRY.
