OVERVIEW OF THE MOST IMPORTANT ACTIVITIES FOR THE WEEK BETWEEN 18 NOVEMBER AND 22 NOVEMBER 2024

INDICTMENT FILED FOR CRIMINAL OFFENCE UNDER ARTICLE 145a OF BiH CRIMINAL CODE

The Prosecutor’s Office of BiH filed an indictment against Miodrag Malić*, born in 1962 in Banja Luka, citizen of Bosnia and Herzegovina, previously convicted.

The charges against the defendant are that in the Banja Luka area, during the protest of political parties, he went on the stage with the photographs of the persons convicted by final and binding judgments of the Hague Tribunal and thus glorified the persons who were sentenced by final and binding judgments of the International Criminal Tribunal, and caused disturbance among the citizens living in Banja Luka and BiH, whereby he committed the criminal offence of Provoking national, racial and religious hatred, discord and intolerance in violation of Article 145a (6) of the Criminal Code of BiH.



CUSTODY MOTION AGAINST SUSPECT RADOMIR NINKOVIĆ*


The Prosecutor’s Office of BiH submitted to the Court of BiH a motion to order into custody the suspect Radomir Ninković (1979) from Trebinje, citizen of Bosnia and Herzegovina. The ordering of the custody measure has been proposed for the reasons set out in Article 132 (1), (a) and (b) of the Criminal Procedure Code of BiH.

The suspect was deprived of his liberty within the investigation in the case against Radomir Ninković et al. because of the grounds for suspicion that he committed the criminal offence of Organised crime set out in Article 210a of the same Code. Evidence obtained from the SKY application was used in this case.



INDICTMENT FILED AGAINST TWO PERSONS FOR CRIMINAL OFFENCE OF SMUGGLING OF PERSONS


The Prosecutor’s Office of BiH filed an indictment against Edin Pobrklić*, born in 1987 in Bijeljina, and Emina Begović*, born in 1999 in Sarajevo. The defendants are accused of having committed the smuggling of 22 persons from Afghanistan, Pakistan, Syria, Palestine and Egypt, who illegally entered the territory of Bosnia and Herzegovina in the course of 2023 and 2024. They are accused of illegally transporting smuggled persons with the intention of obtaining unlawful property benefits, thereby enabling them to stay illegally in Bosnia and Herzegovina, while the accused Edin Pobrklić prevented officials from performing their official duties with his vehicle, significantly damaging police vehicles. The defendants are accused of having committed the criminal offences of Smuggling of persons under Article 189 of the Criminal Code of BiH, and Obstructing an official person in execution of official authority under Article 358 of the Criminal Code of the Federation of BiH, and Malicious mischief under Article 293 (1) of the Criminal Code of the Federation of BiH.



EUROJUST AND EUROPOL ANNOUNCE RESULTS OF OPERATION IN WHICH PROSECUTOR’S OFFICE OF BIH TOOK PART

The international agencies EUROJUST and EUROPOL have published details of activities in the fight against a criminal network involved in the smuggling of a large number of migrants via the Balkan route, in which the Prosecutor’s Office of BiH and police agencies from BiH took part. The activities in BiH involved three suspects, BiH citizens, who are accused of having participated in a migrant smuggling ring. The investigation was conducted by a Joint Investigation Team (JIT) established by EUROJUST to facilitate judicial cooperation between participating countries and the operation was carried out within the Operational Taskforce established by EUROPOL. Germany, Bosnia and Herzegovina, Austria, the Netherlands, Poland, Serbia, Great Britain and other European countries took part in the activities in question.
