INDICTEE IN CODENAME VOLAN CASE EXTRADITED TO BIH JUDICIARY FROM FR GERMANY
The Prosecutor’s Office of Bosnia and Herzegovina filed a motion for remand in custody for the accused Davor Ninković, born in 1980 in Sarajevo, who was extradited to Bosnia and Herzegovina from FR Germany. The accused is charged within the Danilo Cicović et al. case for the criminal offense of Organized Crime under Article 250 of the Criminal Code of BiH in conjunction with the criminal offense of Aggravated Theft under Article 287, paragraph 1 subparagraph a) of the Criminal Code of FBiH, as well as other criminal offenses.
AN EXHUMATION WAS CARRIED OUT IN THE BRČKO DISTRICT AREA
The exhumation process was carried out at the site of the village of Vučilovac, in the Brčko District of Bosnia and Herzegovina. No remains were found at the said location.
REMAND IN CUSTODY PROPOSED FOR THE SUSPECT RADENKO ZELJKOVIĆ
The Prosecutor’s Office of Bosnia and Herzegovina filed a motion for remand in custody for the suspect Radenko Zeljković, born in 1974 in Banja Luka. Remand in custody was proposed for the reasons described in Article 132, paragraph 1, subparagraphs a) and c) of the CPC of BiH.
The suspect is charged with the criminal offense of Accessory After the Fact, under Article 232, paragraphs 1 and 2 of the Criminal Code of Bosnia and Herzegovina, and the criminal offense of Forging Documents under Article 347 of the Criminal Code of Republika Srpska.
FIRST INSTANCE JUDGEMENT FOR PROVOKING ETHNIC, RACIAL AND RELIGIOUS HATRED, CONFLICTS AND INTOLERANCE
The indictment in the case was issued on 27 February this year. During the presentation of evidence, the prosecution called four witnesses and one expert witness and submitted around 20 pieces of evidence. The Court of Bosnia and Herzegovina handed down the judgement on 25 July 2024, by which Samir Nukić, born in 2002 in Bihać, was sentenced to a suspended prison sentence of 3 months, which will not be carried out providing he does not commit a new criminal offense in the next three years.
This is a first instance judgement and there is a possibility of appeal, on which the prosecution will decide after receiving the written copy of the judgement.
Samir Nukić was charged with the criminal offense under Article 145a. CC BiH i.e. charged with having posted on social networks curse words and hatred directed towards the victims – Ethnic Croat children during the commemoration of the tragic death of eight children in Vitez, who were killed by a grenade explosion on the playground in 1993.
PROHIBITING MEASURES PROPOSED FOR SUSPECT HARIS KURBEGOVIĆ
The Prosecutor’s Office of Bosnia and Herzegovina filed a motion for prohibiting measures against the suspect Haris Kurbegović, born in 1998 in Sanski Most. Prohibiting measures were proposed pursuant to Article 126, paragraph 2 and Article 126a paragraph 1 subparagraphs d) and c) of the CPC BiH.
The suspect is charged with the criminal offense of Preventing Official Person in the Exercise of Official Duty under Article 241a, paragraph 2 in conjunction with paragraph 1 of the CC BiH.
