Milanko Kajganić, Chief Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina, submitted to the Office of the HJSC Disciplinary Prosecutor a report against unidentified prosecutors and unidentified judges, because of the unauthorised publication of a letter from the Court of Bosnia and Herzegovina regarding the indictment of the Prosecutor’s Office of Bosnia and Herzegovina Ref. No. T20 0 KT 0024163 23 (Milorad Dodik et al.).
The report relates to the submission of a preliminary hearing judge’s letter to an unauthorised person allowing them to view its content, that is, it relates to the failure of taking necessary measures to protect the integrity of the criminal file and supervise the persons who have legal access to court and prosecutorial files. As a result of the aforementioned action/omission, parts of the aforementioned document were published in the media, which undermined the integrity of the proceedings in the case, as well as the credibility of the Prosecutor’s Office of Bosnia and Herzegovina and the Court of Bosnia and Herzegovina.
Moreover, the Prosecutor’s Office of Bosnia and Herzegovina will act in accordance with the instructions of the Court of Bosnia and Herzegovina from the aforementioned letter, within the time limit provided by law.
