In the presence of his attorney, the accused Zejid Šabić, born in 1969 in Velika Kladuša, a citizen of Bosnia and Herzegovina, has fully admitted his guilt for the commission of the criminal offense of Organizing a Group or Association for the Purpose of Perpetrating the Criminal Offence of ‘Smuggling of Migrants’, referred to in Article 189a of the Criminal Code of Bosnia and Herzegovina, in conjunction with the criminal offense of Smuggling of Persons, referred to in Article 189 of the Criminal Code of Bosnia and Herzegovina.
Pursuant to the Plea Agreement, a single sentence of three (3) years of imprisonment has been proposed for the accused, as well as the confiscation of instrumentalities used in the perpetration of the said criminal offense, including a mobile phone and SIM cards.
Pursuant to Article 110 of the Criminal Code of Bosnia and Herzegovina, illegal proceeds of crime in the amount of BAM 3,300, which were acquired by the commission of the criminal offence, will be confiscated from the accused and the accused is obliged to pay this amount of money within one (1) month from the day the Judgment of the Court of Bosnia and Herzegovina, rendered on the basis of this Plea Agreement, becomes final and binding.
The proposed sentence is adequate to the role and responsibilities of the accused in the commission of this criminal offense.
This accused person is charged with transporting and smuggling illegal migrants who did not meet the conditions for a legal entry and stay in Bosnia and Herzegovina, from the territory of Bosnia and Herzegovina, mainly from the territory of the Una-Sana Canton, towards the territory of the Republic of Croatia and the European Union.
Having reviewed this Plea Agreement, the Court of Bosnia and Herzegovina has accepted it and sentenced the accused.
