The suspects are charged with the criminal offences of Unlawful Deprivation of Liberty under Article 147 and Obstruction of the Justice under Article 241 of the Criminal Code of Bosnia and Herzegovina.
A Prosecutor of the Special Department for Organised Crime, Economic Crime and Corruption has filed an indictment against:
- Vahidin Šahinpašić, born in 1974 in Sarajevo, a citizen of BiH.
The suspect is charged that on 30 August 2017, he as the then Acting Head of the Criminal Investigation Department of the State Investigation and Protection Agency of BiH, in the rank of independent inspector, without respecting internal procedures, and without the knowledge or order of the competent prosecutor and court issued an order to SIPA employees to locate and deprive J.Š.Đ of liberty.
Acting on the orders and instructions of the suspect Vahidin Šahinpašić, SIPA employees arrested the said person and unlawfully detained him deprived of liberty.
The suspect is also charged that on the night between 5th and 6th September 2017 he, in the capacity of Acting Head of the Criminal Investigation Department of the State Investigation and Protection Agency of BiH, in the rank of an independent inspector, used threats, intimidation and promises and offered illicit benefits, and forced J.Š.Đ. to drink alcohol in order to give a false statement against the then acting Chief Prosecutor Gordana Tadić and the then Vice President of the HJPC Ružica Jukić.
Vahidin Šahinpašić is charged that he, as an official person in the BiH institutions, unlawfully deprived another person of his freedom of movement and used threats, intimidation and promises and offered illicit gain in order to induce another to give false testimony in criminal proceedings under the law of Bosnia and Herzegovina, whereby he would commit the criminal offence of Unlawful Deprivation of Liberty under Article 147 (1) of the Criminal Code of BiH and the criminal offence of Obstruction of the Justice under Article 241 (1) of the Criminal Code of BiH.
The indictment was forwarded to the Court of BiH for confirmation.
