The person accused in the case codenamed ‘Damar’ has entered into a plea agreement admitting his guilt. The sentence of imprisonment and confiscation of illegally acquired material gain has been proposed.
The accused Momčilo Zirojević aka ‘Momo’, born in 1960 in Gacko, residing in Bijeljina, has fully admitted his guilt for the commission of the criminal offence of Organized Crime, as referred to in Article 250, Paragraph 2, in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina, in conjunction with the criminal offence of Unauthorized Production and Sale of Intoxicating Drugs, as referred to in Article 207 of the Criminal Code of Republika Srpska, all in conjunction with Article 54 of the Criminal Code of Bosnia and Herzegovina.
The Prosecutor’s Office proposes the pronouncement of the sentence of imprisonment against the accused, for a term of three (3) years and six (6) months, and the proposed sentence is in accordance with the role of the accused in the commission of the criminal offence described in the Indictment.
Moreover, pursuant to the Plea Agreement, objects used in the commission of the criminal offence, including a mobile phone and a SIM card and 2085 plants of marijuana-skunk narcotic drug will be confiscated from the accused, along with the special equipment with climatic and technical possibilities for the production and cultivation of narcotic drugs.
The amount of BAM 10,000 will be confiscated from the accused as unlawfully acquired material gain.
By virtue of signing this Plea Agreement, the accused has fully acknowledged his responsibility for the committed criminal offence and he has waived his right to a trial, as well as the right to appeal the judgment pronounced against him by the Court of Bosnia and Herzegovina on the basis of this Plea Agreement.
The Plea Agreement has been forwarded to the Court of Bosnia and Herzegovina for consideration.
