PROSECUTOR’S OFFICE OF BIH FILED A MOTION FOR REMAND IN CUSTODY OF FARIOL DIZDARI (1987) BECAUSE OF SMUGGLING OF PERSONS

A Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the BiH Prosecutor’s Office filed a motion to the Court of BiH for remand in custody of Fariol Dizdari - born on July 11, 1987 in Shkoder, Republic of Albania, residing in Tirana, citizen of Albania - on suspicion of having committed the criminal offense of Smuggling of Persons under Article 189 (2) of the CC BiH.

PROSECUTOR’S OFFICE OF BIH FILED A MOTION FOR REMAND IN CUSTODY OF FARIOL DIZDARI (1987) BECAUSE OF SMUGGLING OF PERSONS

Following the questioning of the suspect the Assigned Prosecutor filed a motion for remand in custody for a period of one month on grounds stipulated in Article 132 (1) (a) and (b) of the Criminal Procedure Code of BiH i.e. due to risk of flight; due to risk that, if released, the suspects might interfere with criminal proceedings by influencing witnesses, accomplices or harborers.

Fariol Dizdar is suspected of having enabled illegal transfer of citizens of the Republic of Albania across the customs line from Montenegro to Bosnia and Herzegovina.

He is suspected of having committed a criminal offense by way of waiting in a vehicle on the territory of Bosnia and Herzegovina, as previously agreed, for a person who crossed illegally on foot avoiding border control measures from Montenegro to Bosnia and Herzegovina, with the intent to meet the suspect in Trebinje who would then drive him to the Republic of Italy. However the smuggling was prevented by authorized officials.

Police patrol of the Border Police Unit Trebinje controlled a vehicle that was owned by a smuggled person at Klobuk. The vehicle was driven by the suspect Fariol Dizdari and three foreign nationals were inside i.e. one national of the Republic of Albania and two persons who possessed the identity card of the Republic of Bulgaria who have all entered BiH through IBP Klobuk and then waited for the aforementioned person who has crossed illegally on foot from Montenegro to Bosnia and Herzegovina, with the intent to continue travelling with them towards the Republic of Italy.

Motion for remand in custody has been submitted to the Court of BiH.
