BIH PROSECUTOR’S OFFICE PUT FORWARD A MOTION FOR PRE-TRIAL CUSTODY AGAINST SIX SUSPECTS OF WAR CRIMES COMMITTED IN THE TERRITORY OF BUŽIM

Having questioned the suspects, the Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of Bosnia and Herzegovina has put forward a Motion with the Court of Bosnia and Herzegovina, proposing pre-trial custody against six (6) persons suspected of the perpetration of war crimes in the territory of Bužim Municipality.

The Prosecutor in charge of this case has put forward a Motion for pre-trial custody for a duration of thirty (30) days, against these suspects: Zijad Nanić (1963), Esad Kudelić (1966), Senad Salkić (1967), Samir Isaković (1971) and Hasan Mustafić (1954), all from Bužim, and Nedžad Bapić (1975) from Bosanska Krupa.

The measure of custody has been proposed against these suspects for reasons as stipulated by Article 132, Paragraph 1, item b) of the Criminal Procedure Code of Bosnia and Herzegovina, or due to the risk that the suspects, if at large, might hinder investigation, conceal evidence or influence witnesses or accessories in order to cover up the criminal offense.

These suspects are subject to investigation due to the existence of grounds for suspicion that Zijad Nanić and Esad Kudelić committed the criminal offenses of War Crimes against Civilians, as referred to in Article 173 of the Criminal Code of Bosnia and Herzegovina and War Crimes against Prisoners of War, as referred to in Article 175 of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 180, Paragraph 2 of the Criminal Code of Bosnia and Herzegovina, and that Nedžad Bapić, Senad Salkić, Samir Isaković and Hasan Mustafić committed the criminal offenses of War Crimes against Civilians, as referred to in Article 173 of the Criminal Code of Bosnia and Herzegovina and War Crimes against Prisoners of War, as referred to in Article 175 of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 180, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The aforementioned Motion for ordering pre-trial custody has been put forward with the Court of Bosnia and Herzegovina.
