INDICTMENT ISSUED AGAINST TWO PERSONS FOR THE CRIMINAL OFFENSE OF SMUGGLING OF ILLEGAL PESTICIDE

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption has issued an Indictment against the following persons: 1. Branimir Andrić, born on 03 December 1985 in Bijeljina, a citizen of Bosnia and Herzegovina 2. Mladen Cacanović, born on 14 January 1976 in Loznica, a citizen of Bosnia and Herzegovina.
INDICTMENT ISSUED AGAINST TWO PERSONS FOR THE CRIMINAL OFFENSE OF SMUGGLING OF ILLEGAL PESTICIDE
These accused persons are charged with transporting approximately 65 liters of Furadan pesticide from Serbia to Bosnia and Herzegovina while avoiding the measures of the customs control at the Šepak border crossing, in the night of the 20th of March 2014, in the passenger’s car owned by the accused Cacanović. This pesticide is prohibited in Bosnia and Herzegovina because it may have harmful effects on the health of people and animals. The Furadan pesticide is prohibited for use, pursuant to the Law on Phytopharmaceutical Substances in Bosnia and Herzegovina, because it contains the active substance of Carbofuran and it is extremely toxic so it may cause poisoning; therefore, its use is prohibited in Bosnia and Herzegovina. The aforementioned pesticide was found and confiscated by police officers of the Border Police of Bosnia and Herzegovina and, in its Indictment, the Prosecutor’s Office of Bosnia and Herzegovina has requested confiscation of this substance, pursuant to Article 214, Paragraph 4 of the Criminal Code of Bosnia and Herzegovina. These accused persons are charged with moving across the customs line goods the import of which is prohibited in Bosnia and Herzegovina, whereby they committed the criminal offense of Smuggling of Goods, as referred to in Article 214, Paragraph 2 of the Criminal Code of Bosnia and Herzegovina. The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
