INDICTMENT ISSUED FOR WAR CRIMES COMMITTED IN THE VILLAGE OF KUKAVICE NEARBY ROGATICA

The indictment is issued against four accused persons, former members of the Army of Bosnia and Herzegovina, who are charged with war crime in which more than 20 ethnic Serb victims were killed.

A Prosecutor of the Special Department for War Crimes within the Prosecutor’s Office of BiH issued an indictment against the following persons:

1.   Šišić Muhamed, born on September 14, 1963 in Kukavice - Rogatica Municipality, a citizen of Bosnia and Herzegovina,

2.   Drakovac Emir, born on October 10, 1972 in Goražde, employee of the Armed Forces of BiH in the rank of captain, a citizen of Bosnia and Herzegovina,

3.   Šuša Aziz, born on October 6, 1969 in Rogatica, a citizen of Bosnia and Herzegovina, and

4.   Šišić Tarik, born on October 16, 1972 in Rogatica, a citizen of Bosnia and Herzegovina.

The accused are charged with having coordinated and carried out, in their respective capacities i.e.  Muhamed Šišić as the commander of the Sabotage Platoon of the Army of BiH and the other accused persons as members of that Platoon, the attack of the Army of Bosnia and Herzegovina against a column of ethnic Serb refugees who were moving from the direction of Goražde from a place called Jabuka towards Rogatica.

The attack on civilians who were being transported in multiple vehicles occurred in the village of Kukavice - Rogatica Municipality resulting with the killing of at least 21 victims of both sexes, among whom were minors, elderly people and mothers with children. A number of victims were wounded and looting and burning of property transported by the refugees also took place.

The accused Drakovac Emir is also charged with having committed the criminal offense of murder, torture and mutilation by ax of three victims who were tortured and murdered in an extremely brutal way towards the end of 1992 in Foča municipality.

The Prosecutor’s Office of BiH has, together with the Ministry of the Interior of Republika Srpska, conducted a thorough investigation into this case and thanks to the professional and good cooperation of police officers, Prosecutors and investigators collected evidence to indict and prosecute those responsible.

The police officers of RS MoI have played a key role in gathering evidence and testimony of war crimes committed in Kukavice.

The Prosecutor’s Office of BiH forwarded the indictment to the Court of BiH for confirmation along with more than 200 exhibits and proposed a list of more than 80 prosecution witnesses it intends to examine.
