MOTION FOR REMAND IN CUSTODY AND IMPOSURE OF PROHIBITING MEASURES FILED FOR THIRTEEN SUSPECTS ARRESTED IN OPERATION CODENAMED

A Prosecutor of the Prosecutor’s Office of BiH filed a motion for remand in custody to the Court of BiH for twelve suspects and a motion for imposure of prohibiting measures for one suspect, for whom there exist grounded suspicion that they have committed the criminal offense of Organized Crime under Article 250 in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 of the CC BiH.

The Assigned Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH filed a motion for remand in custody for a period of one month (30) days of the following suspects:

1.             Svetozar Perućica (1981) from Bileća, with prior convictions, on the run,

2.             Neđeljko Kuljić (1981) from Bileća, prior convictions, on the run,

3.             Marko Govedarica (1988) from Bileća, on the run,

4.             Srećko Trifković (1985) from Pale, on the run,

5.             Saša Kuljić (1986), from Bileća, a citizen of Bosnia and Herzegovina,

6.             Milenko  Kuljić (1982) from Bileća, a citizen of Bosnia and Herzegovina,

7.             Siniša Kuljić (1984) from Bileća, a citizen of Bosnia and Herzegovina,

8.             Miloš Govedarica (1987) from Bileća, a citizen of Bosnia and Herzegovina,

9.             Vuk Vujović (1983) from Bileća, a citizen of Bosnia and Herzegovina,

10.        Davor Miličević (1972) from Čapljina, a citizen of Bosnia and Herzegovina  and the  Republic of Croatia,

11.        Jozo Rašić (1976) from Ljubuško, a citizen of Bosnia and Herzegovina and the Republic of Croatia,

12.        Zoran Bandur (1963) from Ljubuško, a citizen of BiH and the Republic of Croatia, and

13.        Marko DUNĐER (1986) from Bileća, a citizen of Bosnia and Herzegovina.

The suspects were deprived of liberty in the morning of June 11, 2014 by authorized officers, within the scope of a joint operation codenamed "Šetač II"/Walker II/. They are under investigation by the Prosecutor’s Office of BiH and are suspected of having, as members of an organized group of people, participated in illicit international trafficking of significant amounts of narcotic drug "Cannabis Sativa" also known as "Marijuana-Skunk" from Montenegro to Bosnia and Herzegovina and its subsequent sale to customers in the area of the Republic of Croatia and BiH.

Following the questioning of all the suspects the Assigned Prosecutor filed a motion to  the Court  of BiH  for remand in custody of Svetozar Perućica, Nedjeljko Kuljić, Marko Govedarica and Srećko Trifkovic on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a) and b) of the CPC BiH and at the same time filed a motion to the Court of BiH to issue an international arrest warrant on the grounds that the persons listed are fugitives.

Motion for remand in custody of suspects Zoran Bandur, Davor Miličević and Jozo Rašić was filed on grounds stipulated in Article 132, Paragraph 1, Subparagraphs a) and b) of the CPC BiH, and for suspects Saša Kuljić,  Milenko Kuljić,  Siniša Kuljić, Miloš Govedarica and Vuk Vujović  on grounds stipulated in Article 132, Paragraph 1, Subparagraph b) of the CPC BiH; for the suspect Saša Kuljić the motion was also filed on grounds stipulated in Article 132, Paragraph 1, Subparagraph c) of the CPC BiH.

The remand in custody of suspects was, inter alia, requested due to risk of flight; justified fear that the suspects would, in an effort to hinder and disable the criminal proceedings against them, destroy or hide evidence and clues important to the criminal proceedings; exert influence on witnesses and accomplices; and due to risk that if released, the suspects could repeat the criminal offenses they were charged with.

For the suspect Mako Dunđer the Assigned Prosecutor requested  an order imposing prohibiting measures referred to in Article 126 and 126a. of the CPC BiH i.e. house arrest, ban on leaving Bosnia and Herzegovina, the prohibition of the use of the ID card for crossing the state border, as well as reporting to the competent police station once a week.

Motion for remand in custody and imposure of prohibiting measures was submitted to the Court of BiH and the Prosecutor’s Office of BiH continues to investigate the case.
