THE ACCUSED ODISEJ FOFILOS CONCLUDED A PLEA AGREEMENT

The accused Odisej Fofilos concluded a plea agreement expressing his guilt for the criminal offense of Organized Crime under Article 250, Paragraph 2 in conjunction with the criminal offense of Illicit trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the CC BiH.

The accused Odisej Fofilos aka „Fofi“ or „Grk“ – born on November 11, 1982 in Vareš where he resides, with prior convictions, BiH citizen - entered into plea agreement with the Prosecutor of the Special Department for Organized Crime Economic Crime and Corruption within the Prosecutor’s Office of BiH. 

By virtue of signing the agreement the accused Fofilos fully admitted committing the criminal offenses he was charged with by the indictment of the Prosecutor’s Office of BiH issued on February 4, 2014.

Pursuant to the agreement the Prosecutor, the defense attorney and the accused agree that the accused be rendered a one (1) year imprisonment sentence by the Court of BiH.

The time spent in custody will be calculated into time served.

The accused also agreed to forfeiture of mobile telephone and other items used in commission of the crime pursuant to Article 110 of the Criminal Code of BiH

The proposed sentence is in line with the role of the accused in commission of the criminal offense listed in the indictment.

With this agreement the accused confirms that he is aware of the content of the indictment of the Prosecutor’s Office of BiH. He also confirms that the plea statement was given voluntarily, knowingly, without any coercion or inducement and undertakes to pay the costs of the proceedings in the amount that will, depending on the complexity of proceedings, be determined by the Court of BiH.

By virtue of signing the plea agreement the accused Odisej Fofilos has pledged to testify about all the facts concerning this criminal case i.e. about all perpetrators and co-perpetrators that he knows as members of the organized criminal group as well as about all criminal offenses he has participated in.

Pursuant to this agreement the accused has waived his right to a trial as well as his right to appeal the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of Bosnia and Herzegovina.
