Two persons accused of the commission of the criminal offense of Counterfeiting of Money, as referred to in Article 205, Paragraph 1, as read with Article 54 of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Article 29 of the same Code, have entered into Plea Agreements admitting guilt.
The Plea Agreement with the Prosecutor of the Department III of the Prosecutor’s Office of Bosnia and Herzegovina has been entered into by the following accused persons:
- Edi Kurbegović, born on 31 August 1993 in Ljubljana, the Republic of Slovenia, resident of Sanski Most, citizen of Bosnia and Herzegovina, and
- Admir Mulalić, born on 18 June 1983 in Celje, the Republic of Slovenia, resident of Sanski Most, citizen of Bosnia and Herzegovina.
The aforementioned accused persons have signed their Plea Agreements in the presence of the Prosecutor in charge of the case and their Defense Attorneys, thus fully admitting the commission of the criminal offense they are charged with by the Indictment issued on 29 January 2014, which was confirmed in its entirety by a Preliminary Hearing Judge of the Court of Bosnia and Herzegovina, on 18 February 2014.
The Prosecutor has agreed that, in accordance with this Plea Agreement, the Court of Bosnia and Herzegovina determine and pronounce the following sentences against these accused persons: in relation to Edi Kurbegović, a sentence of imprisonment for a term of five (5) months and, in relation to Admir Mulalić, a suspended sentence for a term of seven (7) months, which will not be executed if this accused person does not commit another criminal offense over a period of two (2) years from the date when this Verdict becomes final and which is accompanied by a fine in the amount of BAM 3,000.00 as an accessory punishment.
These accused persons are charged with the commission of three criminal offenses, in the afternoon and evening of the 10th, 15th and 16th of June 2013, in the settlements of Sanski Most, after previously acquiring, in the manner known to them, four counterfeit banknotes in the denominations of USD 100.00.
The proposed sentences are consistent with the role which these accused persons had in the commission of the criminal offense they are charged with.
By virtue of signing these Plea Agreements, these accused persons have confirmed to be familiar with the content of the Indictment of the Prosecutor’s Office of Bosnia and Herzegovina and to have entered their plea of guilty voluntarily, consciously and with understanding, as well as to have been informed that they may bear the expenses of the criminal proceedings.
Pursuant to these Plea Agreements, the accused persons have committed themselves to paying the damages incurred upon the injured parties in the total amount of BAM 582.00.
By signing these Plea Agreements, these accused persons have waived their right to a trial and right to appeal to the criminal sanction imposed upon them by the Court of Bosnia and Herzegovina.
The Plea Agreements have been forwarded to the Court of Bosnia and Herzegovina.
