THE ACCUSED DŽIHAN BUKVIĆ (1946) CONCLUDED A PLEA AGREEMENT

The accused Džihan Bukvić concluded a plea agreement expressing his guilt for the criminal offense Impermissible Use of Copyrights under Article 243, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The accused Džihan Bukvić – born on February 23, 1946 in Sarajevo where he resides, BiH citizen – entered into plea agreement with the Prosecutor of Department III of the Prosecutor's Office of BiH.

By virtue of signing the agreement the accused person fully admitted committing the criminal offenses he was charged with by the indictment of the Prosecutor’s Office of BiH issued on January 20, 2014 and confirmed by the Court of BiH on January 23, 2014.

Pursuant to the agreement the Prosecutor and the Defense agree that the accused Džihan Bukvić be fined with a BAM 5.00O.00 (five thousand Bosnian Convertible Marks) fine by the Court of BiH, as well as that all items used/ intended for use in commission of the criminal offense and proceeds of crime i.e. photocopies of various copyrighted works including professional literature and computer equipment used for illegal duplication, be forfeited from him in line with Article 243, Paragraph 6 of the CC BiH.

The proposed sentence is in line with the role of the accused person in commission of the criminal offenses.

The indictment charges Džihan Bukvić to have, during 2011 in the premises of his photo-copying shops ,,GRAFO-ART“ d.o.o. Sarajevo, with central offices located in Bistrik No. 7 and Isevića sokak No 4 in Sarajevo, duplicated a number of copyrighted works: high school and university textbooks without the approval of the author, a copyright holder or a person authorized to give permission, aware that those were illegal copies made contrary to the legal provisions on Copyrights and related rights in BiH.

With this agreement the accused confirms that he is aware of the content of the indictment of the Prosecutor’s Office of BiH. He also confirms that the plea statement was given voluntarily and knowingly with full understanding and undertakes to pay the costs of the proceedings in the amount determined by the Court of BiH depending on the complexity of the procedure.

Pursuant to this agreement the accused has waived his right to a trial as well as his right to appeal the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.
