INDICTMENT ISSUED AGAINST A BRITISH CITIZEN FOR SMUGGLING OF PERSONS

A Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH has issued an Indictment against E. X., born on 31 May 1960 in Onrer, Albania, resident of Holton in Great Britain, citizen of Great Britain, held in custody pursuant to the Decision of the Court of BiH.

According to the allegations in the Indictment, the accused E. X. is charged with conducting an unlawful transfer of a foreign citizen from the Republic of Albania across the Republic of Montenegro to Bosnia and Herzegovina, on 04 January 2014, for the purpose of acquiring unlawful material gain and as previously agreed with a person known to him, all with the intent of transporting that person further to Great Britain, although that person does not fulfil conditions for legal entry and residence in the capacity of a migrant in other countries which citizenship, temporary residence permit or registered permanent residence he does not have, which is contrary to the UN Convention against Transnational Organized Crime.

The Indictment further alleges that, on the same day around 7 p.m., the accused E. X. crossed the border in his vehicle and entered BiH in Perućica near Trebinje, and he instructed an Albanian citizen to enter BiH on foot, using inaccessible parts of the terrain that are not marked as border crossing, whereas the accused E. X. was supposed to meet him there and then they were to go together towards Croatia and Slovenia to Italy, and further to Great Britain, but he was prevented from doing so by members of the Border Police of Bosnia and Herzegovina.

The accused person and the smuggled person were stopped and controlled by police on the same day around 7.10 p.m., in Perućica near Trebinje, and then deprived of liberty, whereupon D. M. was processed for misdemeanour, and E. X. was brought to the premises of the Prosecutor’s Office of BiH.

The Indictment charges E. X. with enabling illegal transportation of another person across the state border, out of personal gain, whereby he committed the criminal offense of Smuggling of Persons, as referred to in Article 189, Paragraph 1 of the Criminal Code of BiH.

The Indictment has been forwarded to the Court of BiH for confirmation.
