INDICTMENT ISSUED AGAINST G. M. (1958) FOR ABUSE OF OFFICE OR OFFICIAL AUTHORITY AND DISCLOSURE OF SECRET DATA

A Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH has issued an Indictment against G. M. (1958) from Sarajevo, citizen of BiH and the Republic of Croatia, charged with the criminal offense of Abuse of Office or Official Authority, as referred to in Article 220 of the Criminal Code of BiH and the criminal offense of Disclosure of Secret Data, as referred to in Article 164 of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Article 53 and Article 54 of the same Code.

The accused G. M. is charged with abusing his official position as a Deputy Chief of Financial and Intelligence Department of the State Investigation and Protection Agency and exceeding the limits of his official authority to obtain data in order to communicate or deliver such data to the suspect so that the suspect could evade criminal prosecution in the case in which he is suspected of acquiring property gain in the amount that exceeds BAM 50,000.00.

The accused communicated such data obtained without authorization and made the data accessible to an unauthorized person who, at the time, had a status of a suspect in a case conducted by the Prosecutor’s Office of BiH.

Namely, he helped the suspect to evade the crime that he was suspected to be detected and proven, which would, had such crime been detected and proven, have caused damage to Bosnia and Herzegovina in the amount exceeding BAM 50,000.00,  which represents benefit for the suspect in that case and, at the same time, the damage to the judiciary of Bosnia and Herzegovina and the State of Bosnia and Herzegovina.

According to the allegations in the Indictment, the accused was obliged to act in the interest of conducting and protecting the goals of investigation while performing  his duty within the limits of his authority, pursuant to the law and other regulations, as well as regulations of the State Investigation and Protection Agency, and he was particularly obliged to ensure and implement measures of protection of confidentiality of data and evidentiary and other investigative activities.

The Indictment has been forwarded to the Court of BiH for confirmation.
