ALEN KEŠAN ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

Alen Kešan, accused of the criminal offense of Impermissible Use of Copyrights, as referred to in Article 243, Paragraph 1 of the Criminal Code of BiH, has entered into a Plea Agreement with a Prosecutor of the Department III of the Prosecutor’s Office of BiH, admitting guilt.

Pursuant to the Plea Agreement, Prosecutor and the Accused agree that the Court of BiH impose on the accused Alen Kešan a suspended sentence, by sentencing him to imprisonment for a term of two (2) years which will not be executed if the Accused does not perpetrate another criminal offense over a period of three (3) years, and that, in the sense of Article 243, Paragraph 6 of the CC BiH, objects used for the perpetration of the criminal offence, namely 800 copies of CD/DVD/DIVIX sound and image carriers, be forfeited and destroyed.

By signing the Plea Agreement admitting guilt, the Accused has fully admitted the commission of the criminal offense he is charged with by the Indictment of the Prosecutor’s Office of BiH dated 27 June 2007.

The proposed sentence is consistent with the role the Accused had in the commission of the criminal offense.

With this Plea Agreement, the accused person has confirmed to be familiar with the content of the Indictment of the Plea Agreement. At the same time, he has confirmed to have entered his plea of guilty voluntarily, consciously and with understanding.

With this Plea Agreement, the Accused has waived his right to a trial and right to appeal to a criminal sanction imposed upon him by the Court of BiH.  

The Plea Agreement has been forwarded to the Court of BiH.
