CUSTODY PROPOSED AGAINST FOUR SUSPECTS DEPRIVED OF LIBERTY WITHIN THE “JUG” POLICE ACTION

Prosecutor of the Prosecutor’s Office of BiH has put forward a motion with the Court of BiH seeking custody against four persons suspected of the criminal offense of Organized Crime, as referred to in Article 250, Paragraph 1, in conjunction with the criminal offense of Smuggling of Persons, as referred to in Article 189, Paragraph 1, of the Criminal Code of BiH.

Prosecutor of the Special Department for Organized Crime, Economic Crime, Corruption and Terrorism of the Prosecutor’s Office of BiH has put forward a motion with the Court of BiH seeking custody against the following suspects:

1.   A. S. (1973) from Prizren, citizen of the Republic of Serbia and the Republic of Kosovo,

2.   O. D. (1976) from Bijeljina, citizen of BiH,

3.   V. D. (1978) from Bijeljina, citizen of BiH and the Republic of Serbia, and

4.   I. D. (1978) from Bugojno, citizen of BiH and the Republic of Croatia.

The aforementioned suspects were deprived of liberty on 14 May 2013 by the authorized police officers of the Border Police of BiH and subsequently handed over to the Prosecutor’s Office of BiH within the statutory time.  

The Prosecutor’s Office of BiH finds that there is a grounded suspicion that the aforesaid persons, acting together with other persons, operated as a group for organized crime in the period from the end of January until the mid-April 2013 and was arranging and organizing the smuggling of illegal emigrants, mostly citizens of Kosovo and Turkey, through the Republic of Serbia, Bosnia and Herzegovina and Republic of Croatia to the Western European countries, and these persons did not have residence permit for those countries.  For the thus carried out service of illegal transfer of the citizens of Kosovo and Turkey, this group was taking the agreed amounts of money from those persons.

Having questioned the suspects, the Prosecutor in charge of this case has put forward a motion with the Court of BiH seeking custody for reasons stipulated in Article 132, Paragraph 1, items a), b), and c) of the BiH CPC.

The measure of custody was proposed due to the risk of flight of these suspects and the risk that the suspects, if at large, might hinder the criminal proceedings by influencing witnesses or accessories, as well as due to the risk that the suspects might repeat the same criminal offence they are charged with.

The motion for custody has been forwarded to the Court of BiH, and the Prosecutor’s Office of BiH continues its investigation in this case with the aim of issuing an Indictment. 

In line with the goal of European integration, the Prosecutor's Office of BiH, along with police and law enforcement agencies in BiH and neighbouring countries, undertakes intensive activities aimed at detecting, preventing and prosecuting persons engaged in illegal activities in the field of illegal migration.
