Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against Senada DELIĆ - born on May 29, 1959 in Sarajevo, BiH citizen - charging her with the criminal offense of Impermissible Use of Copyrights under Article 24, Paragraph 1 of the Criminal Code of BiH, in conjunction with the Law on Copyright and Related Rights ("Official Gazette of BiH" no.63/10).
The indictment charges Senada DELIĆ to have, as a director of a Sarajevo photocopying shop, made unauthorized master copies of copyrighted works i.e. textbooks and books of various authors, without permission of the author, other copyright holder, or a person authorized to give approval, and then simultaneously started photocopying books and textbooks which were in greater demand, which is contrary to Article 20, Paragraph 2 of the Law on Copyright and Related Rights ("Official Gazette" no. 63/10).
As alleged in the indictment, during the search of her office building conducted on March 27, 2012 the equipment used for unauthorized duplication, as well as textbooks and books - copyrighted works were found and seized.
The indictment was forwarded to the Court of BiH for confirmation.
