Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against the following persons:
1. Ivan RADIĆ, born on January 19, 1956 in the municipality of Ljubuški where he resides, a citizen of BiH and the Republic of Croatia,
2. Darko BORAS aka "Kulje", born on September 18, 1978 in Ljubuški where he resides, with prior convictions, a citizen of Bosnia and Herzegovina, and
3. Tihomir BULIĆ aka "Tiša", born on January 17, 1966 in Mostar, residing in Čitluk municipality, with prior convictions, a citizen of BiH and the Republic of Croatia.
As alleged in the indictment, on April 19, 2012 the aforementioned accused persons have, prompted by avarice, enabled two nationals of the Republic of Serbia to illegally cross the border.
The accused Tihomir BULIĆ made an agreement with a third party to transport the smuggled persons, for an agreed amount of 200 Euros, across the BiH border into the Republic of Croatia, due to the fact they did not have identity documents and did not comply with the requirements for legal border crossing.
As alleged in the indictment, the accused Tihomir BULIĆ has, as previously agreed with the accused persons Ivan RADIĆ and Darko BORAS, organized the illegal transfer across the state border.
The smuggled persons continued travelling into the Republic of Croatia, where they controlled and detained by Croatian police because they did not possess any identification documents.
The accused are charged with enabling others, for personal gain, to cross the border illegally, thereby committing the criminal offense of Smuggling of Persons under Article 189, Paragraph 1 of the Criminal Code of BiH, in conjunction with Article 29 of the same Code.
The indictment was forwarded to the Court of BiH for confirmation.
