INDICTMENT ISSUED FOR WAR CRIMES COMMITTED IN CENTRAL PRISON AND MILITARY PRISON "VIKTOR BUBANJ" IN SARAJEVO

The Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against F.A. born in 1947 in Sarajevo.

The accused is charged with having, in the period from June to November 1992 during the armed conflict in Bosnia and Herzegovina, as a member of the Military Police of the Territorial Defense of R BiH and a guard in the central prison and military prison located in the "Viktor Bubanj" barracks, participated in a joint criminal enterprise that included several persons and violated the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Times of War.

The accused is charged to have beaten Serb prisoners on several occasions using his hands, weapons and various other objects; to have inflicted serious bodily injuries; to have intimidated prisoners by threats that they would be killed; and to have otherwise beaten, tortured and mistreated several prisoners.

He is charged to have, by use of force and by threat, committed rape and sexual abuse of a Serb female prisoner at the premises of Central Prison in Sarajevo.

The accused is charged with violating the rules of international law in time of war and armed conflict and with having, as a participant in a joint criminal enterprise, committed the criminal offense of War Crimes against Civilians under Article 173, Paragraph 1, Subparagraphs c) and e) of the CC BiH, in conjunction with Article 180, Paragraph 1 of the Criminal Code of BiH.

Given that the accused person can not be found on the territory of Bosnia and Herzegovina, following the confirmation of the indictment, the Prosecution shall undertake activities aiming to render the accused available for criminal proceedings initiated against him.
