Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor's Office of BiH filed a motion with the Court of BiH to remand in custody two persons who are suspected of committing the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 of the CC BiH and criminal offense of Impersonation under Article 396, Paragraph 1 of the CC RS as well as the criminal offense of Forging Documents under Article 377, Paragraph 1 of the CC RS.
Remand in custody was requested for two citizens of Bosnia and Herzegovina:
- D.H. (1974), born in Rogatica, residing in the municipality Ilidža, and
- M.H. (1977), born in Sarajevo, residing in the municipality Ilidža.
The suspects for which the Assigned Prosecutor requested remand in custody were deprived of liberty at the border crossing Uvac on February 18, 2013 by authorized members of the BiH Border Police - unit Višegrad, when the transport of narcotics between Albania and Bosnia and Herzegovina was prevented, by way of stopping the vehicle driven by D.H. in which 16 hidden packages containing marijuana (cannabis sativa), in the total weight of more than 7 kilograms, were found.
Following the questioning of the suspects, the Assigned Prosecutor filed a motion to the Court of BiH to remand the persons into custody for a period of 30 days.
The prosecutor requested custody of the suspect D.H. on grounds stipulated in Article 132, Paragraph 1, Subparagraphs b) and c) of the CPC BiH, and for suspect M.H. on grounds stipulated in Article 132 Paragraph 1, Subparagraph b) of the CPC BiH.
Among other things, custody was requested due to risk that the suspects could suppress evidence, influence witnesses or accomplices in order to prevent collection of evidence and to hinder the investigation, as well as due to grounded suspicion that the suspects, if released, could repeat the criminal offense in question or commit a similar offense.
