BLAŠKO BUDIĆ (1968) AND MIRKO PUŠIĆ (1982) CONCLUDED PLEA AGREEMENTS

The accused persons: Blaško BUDIĆ and Mirko PUŠIĆ concluded agreements on admission of guilt for the criminal offense listed in the indictment of the Prosecutor's Office of BiH of April 20, 2012.

The following accused persons entered into plea agreements:

-        Blaško BUDIĆ – born on April 6, 1968 in Posušje where he resides, citizen of BiH – admitted committing: the criminal offense Associating for the Purpose of Committing Criminal Offenses under Article 249, Paragraph 2, in conjunction with Paragraph 1 of the CC BIH; the criminal offense of Preparation of a Criminal Offence under Article 248 of the CC BiH in conjunction with Article 29 of the CC BiH. The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH put forward a proposal that the accused Blaško Budić be rendered a suspended sentence of 1 (one) year imprisonment by the Court of BiH that shall not be executed providing that the accused does not commit another criminal offence within a 2 (two) year period.

-        Mirko PUŠIĆ - born on August 29, 1982 in Zagorje, residing in Pušići, citizen of BiH - admitted committing: the criminal offense Associating for the Purpose of Committing Criminal Offenses under Article 249, Paragraph 2, in conjunction with Paragraph 1 of the CC BIH; the criminal offense of Preparation of a Criminal Offence under Article 248 of the CC BiH in conjunction with Article 29 of the CC BiH. The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH put forward a proposal that the accused Mirko Pušić be rendered a compound imprisonment sentence of 6 (six) months by the Court of BiH.             

The accused Blaško BUDIĆ and Mirko PUŠIĆ are charged with associating into an  organized group with Agim JEFKAJ and Mijo SPILLMANN, for the purpose of obtaining gain through illegal transfer of 18 Roma persons across the BiH border into the Republic of Croatia, in which they were detected and prevented by a BiH Border Police patrol – Unit Kamensko.

By virtue of signing the agreement the accused persons fully admitted committing the criminal offenses they were charged with by the indictment of the Prosecutor’s Office of BiH issued on April 20, 2012.

The proposed sentence is in line with the role of the accused persons in commission of the criminal offense listed in the indictment of the Prosecutor’s Office of BiH issued on April 20, 2012.

By virtue of the plea agreements the accused persons have also pledged to testify on all facts they are familiar with in this case as well as all perpetrators, co-perpetrators and accomplices in commission of the criminal offenses that they are charged with. The accused persons, thus, agree to testify before the Court of BiH when summoned.

ith this agreement the accused persons confirm that they are aware of the content of the indictment issued by the BiH Prosecutor's Office. They also confirm that the plea statements were given voluntarily, knowingly, with full understanding and without any coercion or persuasion and undertake to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH

Pursuant to this agreement the accused persons have waived their right to a trial and appeal to the criminal sanction that shall be rendered to them by the Court of BiH.

The agreements were submitted to the Court of BiH.
