Prosecutor of the Department III of the Prosecutor's Office of BiH has filed an Indictment against the following persons:
- Dejan Stević aka ‘Stevura’, born on 03 May 1985 in Tuzla, resident of Brčko, citizen of BiH, and
- Miler Ristić, born on 25 February 1977 in Tuzla, resident of Brčko, citizen of BiH.
The Indictment charges Dejan Stević with unauthorized offering, putting into circulation and storing packages with 15 grams of fruit beverage each, with an imprinted ‘Cedevita’ counterfeit trademark, in the catering establishments throughout BiH in the second half of 2011 through the year of 2012, whereas the accused Miler Ristić is charged with unauthorized storing of foil - material for wrapping the aforesaid beverage, in the same period of time, for the purpose of packaging it and putting it into circulation, which is contrary to Articles 1 and 49 of the Law on Trademarks (‘Official Gazette of BiH’, No. 53/10).
As further alleged in the Indictment, the search of the accused persons’ homes, which was carried out on 25 April 2012, resulted in finding 58 parcels, each containing 50 packages with 15 grams of fruit beverage, and 110 rolls of the aforementioned counterfeit wrapping material of various sizes and patterns, which were seized temporarily.
The accused persons Dejan Stević and Miler Ristić are charged with violating another person’s trademark, whereby they committed the criminal offense of Unauthorized Use of Trademarks, in violation of Article 149(6) of the Law on Industrial Property in BiH, in conjunction with paragraph 5 of the same Law.
The Indictment has been submitted for confirmation to the Court of BiH.
