The Prosecutor's Office of BiH has filed an Indictment against Zemir Kovačević, charged with the criminal offense of War Crimes against Civilians, as referred to in Article 173(1),(a),(c),(e) and (f), in conjunction with Article 29 and Article 180(1) of the Criminal Code of BiH.
Prosecutor of the Special Department for War Crimes of the BiH Prosecutor's Office has filed an Indictment against Zemir Kovačević, born on 08 August 1966 in Slavonski Brod, Republic of Croatia, citizen of both the Republic of Croatia and Bosnia and Herzegovina, who has been held in custody since 28 October 2011.
The Accused Zemir Kovačević is charged with acting in violation of the rules of the International Humanitarian Law, namely contrary to Article 3, Article 33 and Article 147 of the Geneva Convention relative to the Protection of Civilian Persons in Time of War dated 12 August 1949, during the armed conflict in Bosnia and Herzegovina, in the months of March, April, July and August of 1992, on the territory of Bosanski Brod Municipality, as a member of the Intervention Platoon of the 1st Bosanski Brod Brigade which grew into the 101st Bosanski Brod HVO Brigade.
The Accused is charged with participating, together with other members of the Intervention Platoon of the aforesaid Brigade and with unidentified members of Croatian Defense Forces (HOS) and Croatian Army (HV), in killings, torture, unlawful confinement, taking to force labor, looting and illegitimate destruction of property of Serb civilians.
Among other things, the Accused is participating as a perpetrator or co-perpetrator in the killings of several Serb civilians which included sick and elderly persons and one minor person.
The Indictment has been forwarded to the Court of BiH for confirmation.
