Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against Izedin ŠIKALO, born on April 1, 1964 in Mostar, residing in Sarajevo, BiH citizen.
The indictment charges Izedin ŠIKALO that on December 1, 2010 in Sarajevo he concluded a Contract concerning a copyright with the Agency for Representation and Protection of Copyrights "Sine Qua Non", in which he as the author - holder of publishing rights transferred the exclusive right to publish the book "Esad Duraković – Duhovna biografija" (Esad Duraković - Spiritual Biography) in the Bosnian language to the publishing company "Dobra knjiga" d.o.o.(Ltd) Sarajevo in which he is the owner and the director.
The aforementioned book was created as a result of previous cooperation between Izedin ŠIKALO and Professor Dr. Esad DURAKOVIĆ i.e. conversations and interviews that Izedin ŠIKALO had with Professor. Dr. Esad DURAKOVIĆ during 2009, after which he, contrary to Article 20 Paragraph 2 of the Law on Copyright and Related Rights ("Official Gazette" no. 63/10), printed 300 copies of this book without permission of Professor Dr. Esad Duraković on December 21, 2010 in the NIST "Bemust" Export-Import d.o.o. Sarajevo, and then put the book in circulation and sold it to various buyers in 2010 and 2011.
The accused Izedin ŠIKALO is charged with having put a copyright into circulation, without permission of the author or any other copyright holder, thus committing the criminal offense of Impermissible Use of Copyright under Article 243, Paragraph 1 of the CC BiH, in conjunction with the Law on Copyright and Related Rights ("Official Gazette of BiH, no. 63/10).
The indictment was forwarded to the Court of BiH for confirmation.
