INDICTMENT FILED FOR SMUGGLING ILLEGAL MIGRANTS

A prosecutor of the Prosecutor’s Office of BiH filed an indictment against Damir Kadrić, born in 1996 in Munich, Federal Republic of Germany, previously convicted, citizen of BiH.

 

 

INDICTMENT FILED FOR SMUGGLING ILLEGAL MIGRANTS

The charges against the defendant are that he, with the intention of acquiring unlawful property gain, on 3 May 2023, in the territory of the municipality of Čajniče, following a prior agreement with a person known to him, accepted five citizens of Bangladesh although he knew that the said persons were illegally transferred from the territory of Montenegro to the territory of Bosnia and Herzegovina at a place that is not intended for crossing the state border, which is contrary to the provisions of Article 6 of the Protocol against the Smuggling of Migrants by Land, Sea and Air, which supplements the UN Convention against Transnational Organised Crime, as well as the Law on Border Control.

 

The defendant carried out the above-mentioned actions with the intention of transporting the migrants to the Sarajevo area, in which way he would allow their transportation and stay in BiH, even though the aforementioned migrants did not meet the conditions for legal residence in BiH provided for in the Law on Aliens, with a view to charging a certain amount of money for the specified service. On the said day, the defendant caused a traffic accident in the Foča area, after which he ordered the smuggled migrants to leave the vehicle and run away to the nearby forest, where they were found by police officers from the Foča Police Department.

 

The defendant is charged with having committed the criminal offence of smuggling of persons set out in Article 189 (2) of the Criminal Code of BiH.

 

The indictment was forwarded to the Court of Bosnia and Herzegovina for confirmation.
