PERSON ACCUSED OF SMUGGLING OF MIGRANTS ENTERS INTO PLEA AGREEMENT ADMITTING HIS GUILT

The accused Shirwan Naseh Ismail, born in 1969 in Sarbier in Irak, a citizen of the Kingdom of the Netherlands and Irak, who is currently in custody, has signed a Plea Agreement in the presence of his attorney, admitting his guilt for the commission of the criminal offence of Smuggling of Persons, as referred to in Article 189 of the Criminal Code of Bosnia and Herzegovina in conjunction with Article 26 of the Criminal Code of Bosnia and Herzegovina.

 

PERSON ACCUSED OF SMUGGLING OF MIGRANTS ENTERS INTO PLEA AGREEMENT ADMITTING HIS GUILT

The accused has admitted to have participated in an international smuggling of persons- foreign citizens on 25 March 2019, for the purpose of acquiring unlawful material gain, and to have attempted to smuggle an Iraqi citizen from Bosnia and Herzegovina to the Republic of Croatia in a rented motor vehicle, in which crime he was detected at the Border Crossing in Gradiška and prevented from committing it by the police officers of the Border Police of Bosnia and Herzegovina.

Pursuant to the Plea Agreement, the pronouncement of the sentence of imprisonment for a term of eight (8) months has been proposed against the accused, and the proposed sanction is in accordance with the role and responsibility of the accused and the gravity of the committed criminal offence.

By virtue of signing this Plea Agreement, the accused person has waived his right to a trial and right to appeal to the Judgment pronounced against him by the Court of Bosnia and Herzegovina on the basis of this Plea Agreement.

The Plea Agreement has been forwarded to the Court of Bosnia and Herzegovina.
