INDICTMENT ISSUED AGAINST 11 PERSONS FOR WAR CRIMES COMMITTED AGAINST ETHNIC SERB VICTIMS IN ČEMERNO NEARBY ILIJAŠ IN 1992

The Prosecutor’s Office of Bosnia and Herzegovina will prove the allegations of the indictment by summoning about 120 witnesses, including survivors and tendering approximately 400 pieces of material evidence.

INDICTMENT ISSUED AGAINST 11 PERSONS FOR WAR CRIMES COMMITTED AGAINST ETHNIC SERB VICTIMS IN ČEMERNO NEARBY ILIJAŠ IN 1992

Prosecutor of the Special Department for War Crimes issued an indictment against the following persons:

1.   Džemal HADŽIĆ, born in 1954 in Kakanj,

2.   Teufik TURUDIĆ akaTufo, born in 1960 in Kakanj ,

3.   Džemal SMOLA aka Haga, born in 1963 in Kakanj,

4.   Senad SIKIRA, born in 1959 in Kakanj,

5.   Benjamin SIKIRA aka Benče born in 1969 in Kakanj,

6.   Haris SIKIRA aka Hare, born on  1 July 1971 In Kakanj,

7.   Enes DURAK, born in 1964 in Vareš,

8.   Mirsad Bešlija, born in 1964 in Ilijaš,

9.   Nusret Bešlija, born in 1962 in Ilijaš,

10. Mirzet Bešlija, born in 1968 in Sarajevo,

11. Hamdija Spahić, born in 1960 in Ilijaš,

The accused are charged with having, during the war and armed conflict in BiH, while acting in their capacities as commanders and members of the structures of the Army of RBiH, the Territorial Defense (TO) and the active and reserve forces of the MoI, acted contrary to the provisions of International Humanitarian Law and the Geneva Conventions relative to the Protection of Civilian Persons in Time of War.

The indictment alleges that the accused persons participated in planning, arranging, preparing, organizing and executing a joint criminal enterprise in order to completely remove all ethnic Serb population of the village of Čemerno, in Ilijaš municipality, by committing  deliberate deprivation of life (killing) of all ethnic Serbs in the village of Čemerno, without making any distinction between RS  Army soldiers and civilians, including captured civilians and members of the RS Army who laid down their weapons, as well as excessive and unwarranted unlawful military destruction of their immovable and movable property.

The indictment alleges that in a synchronized attack on the village in June 1992, at least 30 ethnic Serb victims were killed of both sexes and different ages, including women and minors.  Some of the victims were also tortured and killed in an extremely cruel way and their bodies massacred.

After the attack the village was completely destroyed and the entire ethnic Serb population was expelled from the area, to which no one returned even after the end of the war.

The Prosecutor’s Office of Bosnia and Herzegovina has conducted an extensive and lengthy investigation and collection of evidence in the aforementioned case. The allegations of the indictment will be proved by summoning about 120 witnesses, among them a few surviving victims as well as several protected witnesses. About 400 pieces evidence were tendered with the indictment.

The indictment was forwarded to the Court of BiH for confirmation.
