REMAND IN CUSTODY PROPOSED FOR THREE PERSONS SUSPECTED OF WAR CRIMES COMMITTED IN VLASENICA

Having examined the suspects, the Assigned Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of BiH filed a motion with the Court of BiH for remand in custody of the suspects Mile Kosorić (1953), Rade Garić (1974) and Momčilo Tešić (1963).

The suspects were handed over to the Assigned Prosecutor, following the deprivation of liberty. The Prosecutor examined the suspects and then filed a motion to the Court of BiH for remand in custody on grounds stipulated in Article 132 (1),(b) and (d) of the CPCBIH; for the suspect Milo Kosorić also on the grounds stipulated in Article 132 (1) (a) of the same Code.

Among other things, remand in custody was proposed due to a reasonable fear that the suspects would, if released, interfere with witnesses, accomplices or aides in order to interfere with and prevent the criminal proceedings against them as well as because their release could cause violation of the public order and anxiety among citizens, especially among the population of the injured parties; for the suspect Mile Kosorić remand in custody was also proposed due to risk of flight.

The suspects are under investigation for suspicion of committing War Crimes and Aiding Genocide in the Vlasenica area during 1992-1995.

Mile Kosorić and Momčilo Tešić are suspected of having committed the criminal offense of Genocide under Article 171 of the BiH Criminal Code, in conjunction with Article 180 (1) and  Article 31 of the CC BiH, and Rade Garić is suspected of having committed the criminal offense of Crimes against Humanity  under Article 172 (1)(h) Persecution of the Criminal Code of BiH, in conjunction with Article 172 (1)(a), (e),(f) and (k) of the Criminal Code of BiH, all in conjunction with Article 180 of the CC BiH.
