INDICTMENT ISSUED FOR IMPERMISSIBLE USE OF COPYRIGHTS

Prosecutor of the Department III of the Prosecutor’s Office of BiH has issued an Indictment against Goran Haler aka ‘Goša’, born on 26 July 1956 in Sarajevo, with prior convictions, citizen of BiH, charging him with the Impermissible Use of Copyrights.

The Indictment charges Goran Haler with distributing 1,906 copies of DVD media of various content on the business premises of his ‘AG’ video shop in Sarajevo, on 18 June 2013, without the authorization of the author or other holder of copyright or the person entitled to give authorization under the provisions of Bosnia and Herzegovina, which is in contravention to Article 20, Paragraph 2 of the Law on Copyrights and Related Rights (‘Official Gazette of BiH’, No. 63/10), and with the full knowledge of them being the so-called illegal pirate copies. The Accused had been procuring these sound and image carriers at the market, for 3.00 KM to 5.00 KM per a copy.

In this manner, the accused Goran Haler distributed the work of an author without the authorization of the author or other holder of copyright, or the person entitled to give authorization, where such authorization is required under the provisions of the law of Bosnia and Herzegovina; consequently, he is charged with the commission of the criminal offense of Impermissible Use of Copyrights, as referred to in Article 243, Paragraph 1 of the BiH CC, in conjunction with the Law on Copyrights and Related Rights (‘Official Gazette of BiH’, No. 63/10)

The Indictment has been forwarded to the Court of BiH for confirmation.
