THE ACCUSED ESAD RASTODER (1964)) CONCLUDED A PLEA AGREEMENT

The accused Esad RASTODER concluded an Agreement on admission of guilt for the committed criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina.

The accused Esad RASTODER - born on September 1, 1962 in Berane Municipality - Montenegro, currently residing in Sarajevo, citizen of  Montenegro - entered into a plea agreement with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused Esad RASTODER fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH issued on August 21, 2012. The accused is charged with illicit trafficking of about 5 kg of Marijuana (Cannabis) from the Republic of Montenegro to Bosnia and Herzegovina.

The prosecutor and the defense agree that pursuant to the agreement the accused Esad RASTODER be rendered an imprisonment sentence of one (1) year and a 40.000,00 BAM fine by the Court of BiH.

The agreement also provides for the forfeiture of motor vehicle „Mercedes 202“, owned by the accused.

The proposed sentence is in line with the role of the accused in commission of the criminal offense listed in the indictment of the Prosecutor's Office of BiH issued on August 21, 2012

With this agreement the accused confirms that he is aware of the content of the indictment issued by the BiH Prosecutor's Office. He also confirms that the plea statement was given voluntarily, knowingly, with full understanding, without any coercion or persuasion and undertakes to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial and appeal to the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.
